What is a Tariff?

Tariff means a publication containing the actual rates, charges, classifications, rules, regulations and practices of a common carrier or a conference of common carriers. The term “practices” refers to those usages, customs or modes of operation which in any way affect, determine or change the transportation rates, charges or services provided by a common carrier or conference and, in the case of conferences, must be restricted to activities authorized by the basic conference agreement. See 46 CFR Sec. 520.2.

Who Must Publish a Tariff?

Each vessel operating common carrier, non-vessel-operating common carrier, and conference, except with regard to bulk cargo, forest products, recycled metal scrap, new assembled motor vehicles, waste paper, and paper waste. See 46 CFR Sec. 520.3(a).

When Must a Tariff be Published?

On or before commencement of transportation services, common carriers must have an active tariff in an automated tariff system and submit Form FMC-1 to notify the Federal Maritime Commission of the location of its tariff.
